RELATIONSHIP WITH COMMUNITIES FROM A LEGAL PERSPECTIVE<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Given the pre-colonial existence of indigenous communities, nations\u00a0 and rural indigenous peoples, the Bolivian State recognizes among its\u00a0 fundamental bases their participation in the different areas of economic development, such as mining. That is to say that, from the\u00a0 beginning, the mining activity carried out in Bolivia has been\u00a0 conditioned not only by purely legal and technical aspects, but also\u00a0 includes a strong and determining social component when it is carried\u00a0 out.<\/p>

In this sense, the planning, preparation and especially the execution of\u00a0 mining activities in our country, requires the holders of the mining\u00a0 rights \u2013 in addition to other requirements required by law \u2013 to request\u00a0 what in mining matters is called a \u201csocial license\u201d, which\u00a0 refers to the continuous approval and social acceptance granted by the\u00a0 community of a specific place and\/or interested parties so that the holders of mining rights can carry out specific mining activities. Now, it should be noted that although the figure of the \u201csocial license\u201d is not\u00a0 formally reflected in legal instruments, it constitutes an aspect that\u00a0 takes place based on the recognition of the existence and rights of indigenous, native and peasant peoples.\u00a0the indigenous autonomy recognized in the Framework Law of Autonomies and Decentralization\u00a0 \u201cAndr\u00e9s Ib\u00e1\u00f1ez\u201d and custom as a means of creating\u00a0 law that, due to its habituality over time, has made this figure a legally\u00a0 enforceable aspect.\u00a0<\/p>

On the other hand, Art. 30, paragraph II, numeral 15 and 16 of the\u00a0 Political Constitution of the State covers the figure of \u201csocial\u00a0 consultation\u201d and establishes that any human community that shares\u00a0 cultural identity, language, historical tradition, institutions, territoriality and worldview has the right to be consulted through\u00a0 appropriate procedures, whenever measures are foreseen that may\u00a0 affect the community, respecting and guaranteeing the right to\u00a0 mandatory prior consultation carried out by the State regarding the exploitation of nonrenewable natural resources in the territory\u00a0 inhabited by these communities and allowing their participation in the benefits of the exploitation of the natural resources of their territories.\u00a0<\/p>

In addition, Law 535 of May 28, 2014, Mining and Metallurgy Law,\u00a0 establishes some guidelines on prior consultation in mining matters\u00a0 and indicates that mining operations that include only prospecting and exploration do not require prior consultation per se, and indicates\u00a0 some other exceptions that are not subject to the procedure of said\u00a0 consultation.<\/p>

Thus, it is necessary to understand that both the social license and the prior consultation are processes of intra- and intercultural dialogue, in\u00a0 good faith, free and informed that contemplate, on the one hand,\u00a0 the relationship of the owners and the communities, and on the other hand, the development of successive stages of a procedure between the\u00a0 State, the requesting mining productive actor and the\u00a0 communities as the subject of the consultation. Both figures with the\u00a0 purpose of reaching agreements and cooperation within the\u00a0 ramework of the law.<\/p>

The social license is binding between 1the mining productive actor and the community, and it emerges from strategic agreements and public\u00a0 interest for the development of the country and its administration. In other words, among the objectives sought to be obtained with the\u00a0 social licens , is to promote the development opportunity that\u00a0 ancestral communities have to the extent that they benefit from the\u00a0 agreements obtained\u00a0with mining producers who request a social license.<\/p>

This type of relationship with communities, although it entails a social\u00a0 perspective, is a\u00a0clear example of protection and guarantee of the\u00a0 rights that communities that exercise control over their territories\u00a0 have. A figure that requires the relationship between the productive\u00a0 actors holding mining rights and the community members of the area where the mining activity is desired.\u00a0<\/p>

Some of the legal effects that can emerge from a good or bad relationship with the communities are the total, partial or null\u00a0 authorization of the mining project, the revocation of the social\u00a0 license, and the granting or not of the environmental license based on\u00a0 social aspects that may influence it, the total or partial suspension of\u00a0 the mining project, among others that, in short, constitute and\/or\u00a0 produce legal effects emerging from a social component.\u00a0<\/p>

Thus, the relationship with communities from a legal perspective entails a dynamic and determining challenge for the mining sector,\u00a0 since it encourages growth and economic-social development in rural\u00a0 areas and commits the productive sector to respect for cultures,\u00a0 beliefs, religions, historical traditions, institutions, territoriality and\u00a0 worldview of the ancestral communities that have historically inhabited Bolivia.<\/p>

On November 11, 2023, the Ministry of Mining and Metallurgy issued\u00a0 Ministerial Resolution No. 388\/2023. This resolution extends the\u00a0 deadline until May 5, 2024, for the submission of new applications\u00a0 and the correction of observations in the procedures for conforming\u00a0 Special Transitional Authorizations (STA) to Administrative\u00a0 Mining\u00a0 Contracts (AMC), even for those cases previously out of term.\u00a0<\/p>

This additional period, starting from November 5, 2023, is established\u00a0 after successive extensions of the original deadline, dating back to\u00a0 June 2019. The need for these extensions arises from the legal and\u00a0 social complexities inherent in the process. The mining areas in\u00a0 question, some with rights granted over a century ago, show\u00a0 significant variations in terms of grant date, methods of acquiring\u00a0 rights, and supporting documentation.\u00a0<\/p>

Socially, the situation of entities such as mining cooperatives, which\u00a0 often operate without formal document management procedures, is\u00a0 highlighted. This results in prolonged delays in their regularization.\u00a0 To prevent social conflicts stemming from possible reversions of mining areas, the authority has opted to repeatedly extend the\u00a0 conformity deadline.<\/p>

It is crucial that all mining stakeholders who have not yet initiated or\u00a0 followed up on their conformity procedures take note of this extension\u00a0 as definitive. The mining authority deems this extension final and warns that failure to meet the requirements within the established\u00a0 deadline will lead to the definitive reversion of granted mining rights.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The regulation introduced by Bolivia on November 29, 2023, through\u00a0 Supreme Decree No. 5076, marks a significant change in the\u00a0 supervision of the export of precious metals, with the Central Bank of\u00a0 Bolivia (BCB) playing a predominant role. In this new scenario, the\u00a0 BCB is positioned as the authority that will set limits on the amounts\u00a0 of gold that can be\u00a0 traded internationally, as well as the issuing entity of the indispensable\u00a0 Gold Export Certificate (GEC), without which no gold transaction can be\u00a0 completed.<\/p>

With the entry into force of Board Resolution No. 156\/2023, the BCB has a detailed guide for managing these new responsibilities, including\u00a0 issuing the GEC and setting export quotas. The BCB\u2019s Economic Policy Advisory becomes a key consultative figure, whose\u00a0 role will be to recommend the amounts of gold to be authorized for\u00a0 international sale, with the BCB\u2019s Board having the final say through\u00a0 specific resolutions.<\/p>

This resolution not only determines the mandatory content of the GEC\u00a0 but also defines the verification processes that ensure the export does not compromise national gold reserves. The final decision on the\u00a0 volume of gold released for export is subject to the discretion of the\u00a0 BCB or what its Board deems appropriate in percentage terms.<\/p>

The decree impacts various tariff items, covering everything from gold\u00a0 minerals and their concentrates to gold in different states, and\u00a0 residues and waste containing precious metal. Until the end of 2023,\u00a0 an export quota of at least two tons has been stipulated.<\/p>

The implementation of these measures suggests an effort by the\u00a0 Bolivian state to increase control and supervision over gold exports.\u00a0 The establishment of fixed quotas and the centralization of the\u00a0 GEC\u00a0 issuance process signify a notable increase in the BCB\u2019s regulatory\u00a0 power, which could be perceived as a commercial restriction.\u00a0 However, this approach also reflects a concern to maintain a detailed and updated record of the amounts of gold leaving the country, which\u00a0 could in turn help preserve national reserves.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t
