The Guide for the Issuance of Commercialization Licenses (Version 1), approved through Administrative Resolution AJAM\/DJU\/RES- ADM\/6\/2025, marks an important step in regulating the trade of minerals\u00a0 and metals in Bolivia. Developed by the Jurisdictional Administrative Mining Authority (AJAM), it addresses the need, as identified by various regional\u00a0 offices, for greater uniformity, efficiency, and transparency in the issuance of Commercialization Licenses (CL).<\/p>


Adopted in April 2025 as a mandatory internal instrument for all\u00a0 Departmental and Regional Directorates of AJAM, the guide does not modify\u00a0 Law No. 535 on Mining and Metallurgy or its regulations. Instead, it systematizes existing provisions into clear, standardized procedures for both\u00a0 new applications and adjustment processes. It outlines each stage from\u00a0 application submission to resolution, specifying responsibilities, required\u00a0 documentation, and deadlines. This structure reduces ambiguity, limits\u00a0 administrative discretion, and incorporates modernization measures, including recommendations for a digital license management system with\u00a0 automated alerts.\u00a0<\/p>

The guide reinforces Chapter VI of Law 535, which governs the CL\u2019s\u00a0 requirements, procedures, obligations, and sanctions. Previously, application\u00a0 of these rules varied by region; the guide now ensures consistent\u00a0 enforcement. It also promotes coordination with entities such as\u00a0 SENARECOM, essential for verifying commercialization data, and\u00a0 strengthens links between license issuance and other legal obligations,\u00a0 including payment of the annual Bs 20,000 mining license fee, registration in\u00a0 the Mining Registry, and compliance with environmental and tax\u00a0 requirements.<\/p>

Among its most notable contributions is the standardization of procedures,\u00a0 reducing regional discrepancies and improving process traceability. It\u00a0 introduces a dedicated procedure for adjustment cases, enabling pre-Law 535\u00a0 operators to regularize their activities. This supports oversight and legal\u00a0 compliance.<\/p>

Implementation includes an internal dissemination phase and public\u00a0 outreach via AJAM\u2019s communication channels, ensuring that mining\u00a0 operators understand their rights and obligations. The guide is also designed\u00a0 for periodic updates to reflect regulatory changes or administrative\u00a0 improvements.<\/p>

Conclusion<\/h3>

The Guide for the Issuance of Commercialization Licenses strengthens state\u00a0 oversight of mineral and metal commercialization by translating legal mandates into practical procedures. USE OF MERCURY IN BOLIVIAN MINING AND THE NATIONAL ACTION PLAN UNDER THE MINAMATA CONVENTION<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Although mining is one of Bolivia\u2019s most dynamic economic sectors, the use\u00a0 of mercury remains one of its most polluting practices due to excessive and\u00a0 uncontrolled application. Mercury\u2019s toxic nature causes severe environmental\u00a0 damage, particularly to rivers, protected areas, and\u00a0 Indigenous populations.<\/p>

Many Indigenous communities along contaminated Amazonian rivers\u00a0 depend heavily on fishing for both subsistence and trade\u2014an activity rooted\u00a0 in millennia-old cultural traditions. The Central of Indigenous Peoples of La\u00a0 Paz (CPILAP), representing affected communities, conducted a scientific\u00a0
study revealing alarming results: some individuals were found to have\u00a0 mercury levels five to six times higher than the limits recommended by the\u00a0 World Health Organization (WHO).\u00a0<\/p>

In recognition of the risks posed by mercury use in mining, Bolivia signed the\u00a0 Minamata Convention on Mercury on October 10, 2013, ratified it\u00a0 through Law No. 759 on November 18, 2015, and brought it into force on\u00a0 August 16, 2017. The Convention seeks to protect human health and the\u00a0 environment from anthropogenic mercury emissions and releases. Under\u00a0 Article 7, signatories must prepare a National Action Plan (NAP) within three\u00a0 years, setting out measures to reduce mercury use in Artisanal and\u00a0 Small-scale Gold Mining (ASGM).<\/p>

Bolivia did not meet the original Article 7 deadline but, through the Vice\u00a0 Ministry of Mining Policy, Regulation, and Oversight, has resumed efforts to\u00a0 complete and deliver the NAP before the end of the current government term.\u00a0 The plan focuses on three priority areas: (i) eliminating mercury-based\u00a0 grinding activities, (ii) introducing clean technologies and responsible\u00a0 practices, and (iii) improving extraction efficiency. It is organized into eight\u00a0 strategic pillars:<\/p>

1.Formalization of ASGM operations
2.Reduction of illegal mining
3.Reduction of mercury use
4.Control of mercury imports and consumption
5.Implementation of a Mercury and Health Plan
6.Improvement of gender conditions in the ASGM sector
7.Continuous dissemination of the NAP
8.Enhanced access to financing for ASGM operators<\/p>

The National Action Plan represents a critical step toward cleaner and more\u00a0 sustainable mining in Bolivia. It offers a framework for introducing modern\u00a0 processing methods, tightening mercury import controls, reducing health\u00a0 \u00a0risks, and advancing formalization in the ASGM sector.
